Terms and Conditions

Thank you for your interest in my commissions! Down below are my Terms and Conditions, and you can find my pricing and samples in the section titled commission. Please have a look before submitting your form :)

Artist Rights-
-I reserve the right to decline any work that I find to be outside of my range of ability to complete to the highest standard-I reserve the right to use, publish, livestream, and record the commissioned artwork to share and promote on my social media-If commissioned for fanart of an existing series or franchise, I reserve the right to sell the artwork at any given point (i.e prints)-I retain all copyrights to the commissioned artwork-I will not claim the intellectual property (IP) of the commissioned artwork


Client Use, Obligations, and Understanding-
-The client must fill out the commission form in order to commission me, I will not be accepting personal commissions through any other format besides the commission form unless the work is commercial-By submitting the form, the client agrees to all terms and conditions-The client understands that this is strictly for personal use and may not distributed, reproduce, or otherwise profit from the commission (For any commercial work, please contact [email protected], @tea.gem on instagram, or @teagem23 on twitter so we can discuss further)-The client reserves the right to use the commissioned work as they would like (i.e posting, printing, use on stream or as avatar/banner, etc.) so long as proper credit is given to me as the artist and no profit is made-The client understands that the artwork is not to be used for the purposes of minting NFT or training AI-The client understands that my commissions are generally through a first come first serve basis. Different factors such as the amount of time it takes to receive feedback and rush fees can affect this however.-The client understands that I reserve the right to work on as many commissions as I need to at once


Payments, Additional Fees, & Refunds-
-The client understands that the prices are just base prices and are subject to change depending on the complexity of the piece. Pricing will be discussed after commission is accepted via email-For full character illustration payment will be paid in full upfront, or with a 50% deposit paid upfront with the other 50% paid before receiving the final commission unless otherwise stated. For sketch commissions, payment will be made upfront in full. This will be via paypal in USD and will be initiated via an invoice sent to the client by me-Payment must be received before I start working on the commission-Additional fee of 50% of the commission for any additional character (Max 2)-There will be a revision fee for any revisions made after the revision window (revision window discussed in section titled WIPs and Adjustments)


WIPs and Adjustments-
-The client understands that there will be a revision window in which adjustment can be made free of charge. After this window is closed, any adjustments requested will have a charge depending on the complexity of the change being made-I will provide 3 revision windows in which the client can request revisions
Preliminary Sketches: Rough thumbnail sketches of initial ideas for the client to choose from
[Client can provide any feedback regarding the ideas presented]
Sketch phase: Rough sketch done with dark brown brush
[Client can provide any feedback regarding design/pose during this phase]
Color: Rough flat colors with base lighting
[Client can provide feedback regarding colors during this phase]-Revisions necessary due to my own faults will be free


Process and Delivery-
-Generally you should expect to receive your commission in around 1 week- 3 months of me starting it, but this is just a rough time frame. If I ever anticipate taking longer due to complexity of the piece and any outstand life situation, I’ll be sure to inform you as soon as I can-If you have a deadline, please discuss this with me as I generally will not be doing rushed commission, but if you require it, It will require a large fee depending on the frame requested-Once the commission is finished, you will receive the full-resolution image along with a web-friendly size


Custom Characters & Adoptable Designs-
-When purchasing one of my characters, you are agreeing to a partial transfer of rights. This partial transfer is for personal use only, and I, the artist, retain the copyright of the initial artwork and design to use on my website, portfolio, etc, unless discussed otherwise.-I retain the right to use the original artwork for prints and any future artbooks I choose to sell-As long as it’s for personal use, the client retains the right to use the design in stories, concepts, redraws, commissions, personal printing, reposting on social media, profile pictures, etc, so long as it's for personal use and proper credit is given-If the client intends to use the design for any commercial purposes (games, stories, videos, mascots, merch, or any other form of mass media consumption for profit), the client MUST disclose this when purchasing as a transfer of rights must be made
For more details about commercial pricing, please see the section titled client use, obligations, and understanding--The client is allowed to change the backstory of the character (if applicable. gender, outfit, small details, but initial design should remain generally the same.
The client is allowed to resell or trade the design for equal or lesser value as long as I am informed and the person receiving the design agrees to my terms.-Designs may be purchased as gifts or co-owned as long as all parties agree to my terms


Additional Information-
-Regarding nudity and NSFW: That’s pretty much going to just mean bare breast, I will not draw bottom parts
Additionally this just means nudity, I will not be doing any overtly NSFW/Lewd commissions (This can be discussed further when we being contact)-Regarding sizing: I work in my own standard sizing. That will generally be 24x36in for most pieces but 30x30in for some. Respectively that is 7200x10800 pixels and 9000x9000 pixels. I work in 300dpi-All commissioned work will be done in my art style. This means I will not be taking any realistic portrait commissions*Thank You!♡
